Former Tampa Bay Buccaneers linebacker Nate Webster will have to serve only 10 years of his 12-year prison sentence for having sex with the underage daughter of a former Cincinnati Bengals assistant coach.

The Ohio 1st District Court of Appeals ruled Wednesday prosecutors didn’t prove one of four counts of unlawful sexual conduct with a minor on which Webster was convicted last year. It upheld his other convictions.

Prosecutors say Webster had sex with the girl several times in 2009 when she was 15. Webster says the sex occurred when she was 16, Ohio’s legal age of consent.

The Hamilton County prosecutor’s office hasn’t returned a message seeking comment.

Webster, a third-round pick out of Miami by the Bucs in 2000, was on Tampa Bay’s 2002-03 Super Bowl team.

He signed with the Bengals as a free agent in 2004, but was released in 2005. He played for the Denver Broncos from 2006 to 2008.
