A Valrico software engineer who shot and killed his brother-in-law late Monday night was arrested, authorities said, but not on charges related to the slaying.
Hillsborough County sheriff's deputies arrested Shawn Berg, 39, of 2005 Cimmaron Run Drive, on Tuesday morning, charging him with possession of methamphetamines and oxycodone.
Shot dead was John Danco, who was married to Berg's sister and with whom Berg had an ongoing dispute, deputies said.
Danco, a welder, had a long history of arrests dating to the mid-1990s. Many involved charges of drug possession, and a few were on charges of domestic battery.
Berg has no arrest record, sheriff's spokeswoman Debbie Carter said.
Deputies were called to the home at 11:30 p.m. Monday by Berg, who said he had just shot an intruder who had kicked in his garage door.
Deputies found Danco, 36, 1802 St. Cloud Ave., Apt. 203, dead on the floor of Berg's garage. Berg told deputies that just prior to the incident, Danco called Berg and made threats, Berg told deputies.
"Detectives said that these guys have had bad blood between them for a while," Carter said. "It had been an ongoing dispute."
Early Tuesday morning, deputies obtained a search warrant, and as a result of the search found the drugs, she said.
Whether or not Berg will be charged in Danco's death remains undetermined, Carter said. Detectives will finish the investigation and go over the evidence with prosecutors, she said.
That could take a few days, Carter said.
Berg was booked into the Hillsborough County jail. Bail was set at $4,000.
Under Florida law, homeowners do not have to retreat from a threat in their homes and have the right to use force, even deadly force, to protect themselves and their families. The state's version of the "Castle Doctrine" was signed into law in 2005.
